Recall of Ford Trucks and Products Liability Cases

May 9, 2016

Recently, Ford said it would recall over eighty thousand sport utility vehicles and nearly two hundred thousand pickup trucks to repair a transmission problem. This recall mainly affects 2014 and 2015 Ford Explorers and Ford Interceptors. It also covers a truck that is widely popular on the roads of South Carolina, the Ford F-150. The problem transmission can automatically downshift your vehicle into first gear at the wrong time. While there have been no reported injuries yet, there have been crashes related to this problem. The concerns of a car shifting out of gear are obvious because a sudden drop in speed while moving could cause serious injury or death.

My vehicle has been recalled, what can I do?

If you have been injured in a vehicle that has been recalled, it is important to contact an experienced attorney as soon as you can. An attorney who has proven skills in personal injury cases can help explain how to proceed with a potential lawsuit. If a vehicle has been recalled, that means the manufacturer believes the vehicle is too dangerous to be on the road.

It is often the case that a recall of a vehicle comes from a problem with the design in the product itself. In South Carolina there are a few different theories someone can bring a products liability case under. The first is defective design. A case can be brought under a defective design theory when a vehicle is unsafe because of the way it was designed. A second theory a case can be brought under is a manufacturing defect theory. A manufacturing defect occurs when the design of the product itself has no problems, but something went wrong in the production of the product. A third type of theory is a failure to warn of danger. However, it does not seem that this particular type of theory will receive much recognition in a vehicle recall case.
