Resolving Your Car Accident Claim In Court
Car accidents can happen due to a variety of causes. Adverse weather, poor road conditions, and the time of day may all be a factor. However, in the majority of cases, it is the reckless actions of others on the road which are ultimately responsible. These drivers can be held accountable when serious personal injuries or deaths occur as a result. While an insurance claim is always an option, in cases of severe car accidents, such as the one that recently occurred in Aiken, the best course of action may be taking the at-fault driver to court. Couple Killed In Fatal Car Accident While Children Were In Backseat
Two small children in Aiken are left to deal with the devastating loss of their parents due to the reckless actions of another driver on the road. According to a December 16, 2019 news report by The State, an Aiken County couple was traveling on Charleston Highway around 9:00 p.m. on a Saturday night when they were struck by a 25-year-old Denmark woman headed in the opposite direction.
While the other driver fled, paramedics, rushed to the scene. Both the driver and their partner, who was seated in the front seat, died as a result of their injuries. Their two young children, who were seated in the back of the vehicle, were rushed to Augusta University Medical Center with serious injuries.
Police began searching for the hit and run driver and apprehended her just a day after the crash. She faces a host of criminal charges, including hit and run, driving under a suspended license, and having an open container of beer or wine in the vehicle. She also faces liability both for the injuries suffered by the children and for the wrongful death of the parents.
Non-Economic Damages Car Accident Claims
When a car accident happens, insurance policies may be in place to cover the expenses suffered by victims. When a major crash resulting in death or life-threatening injuries occurs, rather than seeking compensation through the insurer, the better option may be resolving your car accident claim in court.
In addition to costs such as current and future medical expenses and lost wages victims suffer, the South Carolina Code allows them to seek non-economic damages. These include intangible costs, such as:
The pain caused by the accident or their injuries
The emotional trauma they endured as a result
The loss of enjoyment in life they suffer due to a loved one’s death or their own disabilities.
Punitive damages are an additional amount the judge may order, designed to punish the at-fault party for conduct that was particularly reckless and negligent. Non-economic damages can easily represent hundreds of thousands of dollars, making up a significant portion of your claim.
