DUI Charges Increase Over The Summer

The summer months typically mean an increase in drivers on the road. Many of us will be taking road trips to the beach or hanging out locally, engaging in our favorite hobbies, and attending outdoor events. Adult beverages are often included as part of these activities. In addition to the dangers associated with driving under the influence, it is important to be aware of the legal risks and the fact that DUI charges significantly increase over the summer.

DUI Risks

Having something cold to drink goes hand in hand with many summertime activities. While there is nothing wrong with having a few alcoholic beverages, you are putting yourself and others at risk if you get behind the wheel.

According to statistics from the National Highway Traffic Safety Administration (NHTSA), car accidents in general spike during the summer months. Close to 10,000 people across the country are killed each year in crashes between the months of June and August, while tens of thousands of others suffer serious personal injuries. Driving under the influence is one of the most common causes.

Even if you are not involved in an accident, there is a strong risk of getting pulled over by law enforcement. Police are aware of summer DUI dangers and are alert for motorists who may be under the influence. Times when you are most at risk of running into a checkpoint or being pulled over for DUI are:

  • Between the hours of 10:00 p.m. and 2:00 a.m.

  • Anytime on weekends

  • The days before and after holidays

  • Near outdoor concerts, fairs, sporting events, or any type of activity where alcohol is typically served

Dealing With DUI Charges

During the summer, the South Carolina Department of Public Safety increases their efforts at apprehending suspected DUI drivers through the Sober or Slammer campaign. Officers are more aggressive in looking for signs that drivers are under the influence, such as going either too slow or over the speed limit, making jerking stops, mistakenly driving with lights off at night, and weaving from lane to lane. This is partially why DUI charges increase over the summer.

Even if you show none of these sighs, an expired license, vehicle registration, or even having a headlight or brake light out is all the reason they need to pull you over. If you are stopped, it is important to be aware of your rights:

  • You automatically agree to consent to DUI testing once you get your driver’s license under South Carolina’s implied consent laws. However, you do have the right to refuse. While this could avoid giving police important evidence against you, it could also result in an automatic driver’s license suspension.

  • If you are placed under arrest, you have the right to contact a DUI defense attorney. You should do so immediately. We may be able to dispute the reason for the step or any test results obtained, which can result in your charges being dropped or reduced.
